1. Who we areWarm Outreach is a cookie program operated by Octane Software, Inc. (“Addie,” “we,” “us”). We are, at the end of the day, a software company. We don’t bake these ourselves. They are made for us by a local bakery we partner with, in their licensed commercial facility. We choose the flavors and pay the bill; they do the baking. Neither we nor they are a large food manufacturer with a QA department, and by claiming you acknowledge you understand that.
2. Allergen disclosure — read this if you have any food allergyIf you have allergies, please be advised that our kitchen is DEFINITELY NOT wheat/nut/soy/dairy/peanut-free. Our cookies contain wheat, milk, and eggs, and are made in our partner bakery’s shared commercial kitchen, where they may come into contact with peanuts, tree nuts, soy, and sesame.
All cookies are baked in the same ovens (although flavors with nuts and gluten-free cookies are baked on separate trays). Even so, neither we nor our bakery can guarantee against cross-contamination between trays, ovens, equipment, surfaces, or other materials in a shared facility. If you have a serious or life-threatening food allergy, do not eat our cookies.

Our cookies are not gluten-free, vegan, kosher, halal, dairy-free, nut-free, sugar-free, or free of anything else, unless a specific product explicitly says so. Do not assume anything about any product beyond what is stated on its label.

3. Assumption of riskThis is food. Food carries inherent risks, including allergic reaction, spoilage, and improper storage after delivery. You assume all risks associated with consuming our products. Once a package is delivered, storage and handling are your responsibility. Cookies are baked goods without preservatives and should be eaten within a few days of arrival (or frozen; they freeze well). If your order arrives damaged or otherwise not as intended, contact us and we will try to make it right — but “make it right” is at our discretion and does not create any obligation.
4. No warrantiesProducts are provided “as is.” We make no warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do our best to ship you quality, safe cookies. We guarantee nothing.
5. Limitation of liabilityTo the maximum extent permitted by law, our total liability for any claim arising from your order is limited to the amount you paid for that order — which, for free cookies, is zero. We are not liable for indirect, incidental, or consequential damages of any kind. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
6. Eligibility, refusal of service, and program changesWe may refuse service, cancel claims, or revoke eligibility to anyone, at any time, at our sole discretion, with or without explanation. Eligibility (including title verification) is determined solely by us and our rulings are final. Program terms — quantities, eligibility rules, cookie lineups, drop schedules, and everything else — are subject to change at any time without notice.
7. Free productsFree cookies are a gift, not a sale. All the same disclaimers apply, and receiving free product creates no obligation on our part of any kind, including any obligation to provide free product again.
